GetMusic.fm Terms of Service

When you use GetMusic.fm's products or services, you are agreeing to these latest Terms of Service ("Terms"). Violation of these terms may, at our discretion, result in us terminating your account.

We may update these Terms of Service at any time. If we make significant changes, we will refresh the date at the top of this page and notify users who have signed up to our policy updates mailing list.

Definitions

"Company", "we", "our", or "us" refers to GET MUSIC, LLC, a Delaware limited liability company doing business as GetMusic.fm.

"Services" refers to our website, getmusic.fm, and any product created and maintained by GET MUSIC, LLC, including our marketing services for DIY musicians and our platform for promoting Bandcamp download codes.

"You" or "your" refers to the people or organizations that own an account with our Services, including artists, fans, and labels.

Account Terms

1. You are responsible for maintaining the security of your account and password. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
2. You may not use the Services for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
3. You are responsible for all content posted and activity that occurs under your account.
4. You must be a human. Accounts registered by "bots" or other automated methods are not permitted.
5. Artists and labels are responsible for the accuracy of the information they upload about their releases and artist profiles.

User Representations

By using the Site, you represent and warrant that:

1. All registration information you submit is truthful and accurate.
2. You will maintain the accuracy of such information.
3. You are at least 18 years of age.
4. Your use of the Site does not violate any applicable law or regulation.

Payment, Refunds, and Plan Changes

1. Artists receive one free promotion upon signup. Additional promotions require the purchase of credits.
2. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. You are responsible for payment of all such taxes, levies, or duties.
3. We reserve the right to refuse service to anyone for any reason at any time.
4. Refunds are handled on a case-by-case basis. Please contact our support team if you believe you're entitled to a refund.

Cancellation and Termination

1. You are solely responsible for properly canceling your account. An email or phone request to cancel your account is not automatically considered cancellation. If you need help canceling your account, you can always contact our Support team at support@GetMusic.fm.
2. All of your content will be immediately inaccessible from the Services upon account cancellation. Within 30 days, all content will be permanently deleted from active systems and logs. Within 60 days, all content will be permanently deleted from our backups. We cannot recover this information once it has been permanently deleted.
3. We reserve the right to suspend or terminate your account and refuse any and all current or future use of our Services for any reason at any time. Suspension means you will not be able to access the account or any content in the account. Termination will furthermore result in the deletion of your account or your access to your account, and the forfeiture and relinquishment of all content in your account.
4. We reserve the right to refuse service to anyone for any reason at any time, including but not limited to violations of these Terms.

Use Restrictions

1. GetMusic.fm reserves the right to restrict or terminate accounts of users who abuse the platform, including but not limited to fans who excessively collect large numbers of download codes without legitimate use.
2. You agree not to:
   • Use the Service for any illegal purpose or in violation of any local, state, national, or international law
   • Violate or encourage others to violate the rights of third parties, including intellectual property rights
   • Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service
   • Take any action that imposes, or may impose at our sole discretion, an unreasonable or disproportionately large load on our infrastructure
   • Upload invalid data, viruses, worms, or other software agents through the Service

Modifications to the Service

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that GetMusic.fm will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

Copyright and Content Ownership

1. All content posted on the Services must comply with U.S. copyright law.
2. We claim no intellectual property rights over the material you provide to the Service. Your profile and materials uploaded remain yours.
3. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services, use of the Services, or access to the Services without the express written permission by the Company.

Privacy

Your use of the Services is also governed by our Privacy Policy, which can be found at [Insert Privacy Policy URL]. By using the Services, you agree to the terms of our Privacy Policy.

Disclaimer of Warranties

1. Your use of the service is at your sole risk. The service is provided on an "as is" and "as available" basis.
2. GetMusic.fm does not warrant that the service will be uninterrupted, timely, secure, or error-free.
3. GetMusic.fm does not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

Limitation of Liability

GET MUSIC, LLC shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use or alteration of your transmissions or content.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
